I. General Terms and Conditions

§ 1 Basic Provisions

  1. The following terms and conditions apply to contracts concluded between you and us as the provider (Kim Seitz) via the website https://sydneykjewelry.com/, unless otherwise agreed. Any terms proposed by you that conflict with or deviate from these terms are expressly rejected unless otherwise agreed upon.

  2. A consumer within the meaning of these terms and conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is any natural or legal person or a legally recognized partnership that, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.

§ 2 Conclusion of the Contract

  1. The subject of the contract is the sale of goods.

  2. By displaying the respective product on our website, we make you a binding offer to conclude a contract under the conditions specified in the item description via the online shopping cart system.

  3. The contract is concluded via the online shopping cart system as follows:

    • The goods intended for purchase are placed in the "shopping cart." You can access the "shopping cart" via the appropriate button in the navigation bar and make changes at any time.
    • After clicking the button "Checkout" or "Proceed to Order" and entering personal information, payment, and shipping details, the order summary will be displayed.
    • If you use an instant payment method (e.g., PayPal, Amazon Pay, or similar), you will either be redirected to the payment provider’s site or see the order summary in our online shop. After completing the payment process, you will return to our site where the order summary will be displayed.
    • Before submitting the order, you can review and edit the details or cancel the order using your browser’s "back" function.
    • By submitting the order via the corresponding button ("place order," "buy now," etc.), you accept our offer, and the contract is concluded.

  4. Requests for quotations outside the online shopping cart system are non-binding. We will send you a binding offer in text form (e.g., by email), which you can accept within 5 days unless otherwise specified.

  5. Order processing and transmission of all necessary information related to the contract are carried out via email, partly automated. Ensure the email address provided is correct, and emails are not blocked by spam filters.

§ 3 Customized Products

  1. You are required to provide any necessary information, texts, or files required for the customization of products promptly after contract conclusion. Our guidelines for file formats must be observed.

  2. You agree not to provide data that infringes third-party rights (e.g., copyrights, trademarks) or violates laws. You indemnify us against all claims arising from any such infringement, including legal defense costs.

  3. We do not verify the accuracy of the data provided by you and accept no liability for errors resulting from such data.

§ 4 Retention Rights, Retention of Title

  1. You can only exercise a right of retention if it concerns claims arising from the same contractual relationship.

  2. Ownership of the goods remains with us until full payment of the purchase price.

§ 5 Warranty

  1. Statutory rights of liability for defects apply.

  2. Consumers are requested to inspect the goods upon delivery for completeness, obvious defects, or damage during transport. Notify us and the shipping company of any issues promptly. Failure to do so does not affect statutory warranty claims.

  3. If any product feature deviates from the objective requirements, it will only be deemed agreed if you were expressly informed before submitting your contractual statement and the deviation was explicitly agreed upon between the parties.

§ 6 Governing Law

  1. German law applies. For consumers, this choice of law only applies to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state of their habitual residence.

  2. The provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG) expressly do not apply.

3. Language and Storage of the Contract

  1. Contract language is German.
  2. The full text of the contract is not stored by us. Before submitting your order, you can print or electronically save the contract details using your browser’s print function.

5. Pricing and Payment Terms

  1. Prices include all applicable taxes. Shipping costs are not included in the purchase price and are displayed during the order process.
  2. Payment is due immediately unless otherwise specified in the individual payment method.

6. Delivery Terms

  1. Delivery conditions, delivery times, and any restrictions are indicated in the respective product description.
  2. The risk of accidental destruction or deterioration of the sold item transfers to you upon receipt.
